Terms of Service

1. Introduction and Acceptance

Welcome to EasyNatis. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and EasyNatis (Pty) Ltd ("EasyNatis", "we", "us", or "our"), a company registered in the Republic of South Africa.

By accessing or using our website, mobile application, or services, you agree to be bound by these Terms, our Privacy Policy, and all applicable South African laws, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), and the Protection of Personal Information Act 4 of 2013 ("POPIA").

If you do not agree to these Terms, please do not use our services.

2. Service Description

2.1 What We Offer

EasyNatis provides a vehicle license disc renewal service for vehicles registered in South Africa. Our services include:

  • Monthly payment plans for annual vehicle license renewal fees
  • Submission of license renewal applications to NATIS (National Traffic Information System) on your behalf
  • Nationwide delivery of renewed license discs to your specified address
  • Automated renewal reminders and status notifications
  • Account management through our website and mobile application

2.2 What We Do Not Do

  • We do not issue license discs - only NATIS and authorized registering authorities can do so
  • We do not provide vehicle roadworthiness certificates (COFs)
  • We do not settle outstanding traffic fines on your behalf
  • We do not provide driver's license renewal services (only vehicle license discs)

2.3 Service Availability

Our services are available for vehicles registered in all nine South African provinces. Service availability may be subject to NATIS system availability and government processing times, which are outside our control.

3. Eligibility Requirements

To use our services, you must:

  • Be at least 18 years of age
  • Be a South African citizen, permanent resident, or hold a valid work permit
  • Have a valid South African ID number
  • Be the registered owner of the vehicle, or have authorization from the registered owner
  • Have no outstanding traffic fines associated with the vehicle
  • Provide accurate and complete information for the renewal application

4. Payment Terms

4.1 Pricing

Your monthly payment is calculated based on:

  • License Fee: The annual license renewal fee set by your provincial authority (varies by province and vehicle type)
  • Administration Fee: Our service fee, which includes processing and nationwide delivery (currently R300 per renewal cycle)

The total is divided by the number of months until your license expiry date, with a minimum of 1 month and maximum of 12 months. All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable.

4.2 Payment Processing

  • Payments are processed securely through Paystack, a PCI-DSS compliant payment provider
  • Monthly payments are automatically debited from your registered payment card
  • You will receive a payment reminder before each debit date
  • Failed payments will be retried within 3 business days

4.3 Late or Failed Payments

If a payment fails or is not received:

  • We will notify you via email and SMS
  • You will have 7 days to update your payment method or make a manual payment
  • Continued non-payment may result in suspension of your renewal service
  • We reserve the right to not proceed with your renewal if payments are not up to date

4.4 Price Changes

Government license fees may change annually. If the license fee changes after you've started your payment plan:

  • We will notify you of any changes to your monthly payment amount
  • You will have the option to continue with the adjusted amount or cancel your subscription
  • Our administration fee is fixed at the time of sign-up for your current renewal cycle

5. Renewal Process

5.1 When We Process Your Renewal

We submit your license renewal to NATIS once you have paid the full amount due (total annual license fee plus administration fee). This typically occurs 1-2 weeks before your license expiry date to ensure timely delivery.

5.2 Eligibility Verification

Before processing your renewal, we verify:

  • Your payment status is fully paid up
  • There are no outstanding traffic fines on the vehicle
  • Your delivery address is valid and within South Africa
  • Your vehicle registration details are accurate

5.3 Blocking Issues

If we identify any issues that prevent your renewal (such as outstanding fines), we will:

  • Notify you immediately via email and SMS
  • Continue collecting your monthly payments
  • Process your renewal once the blocking issue is resolved

5.4 Processing Time

NATIS processing times vary by province and are outside our control. Typical processing times are:

  • NATIS processing: 3-7 business days
  • License disc printing: 1-3 business days
  • Delivery: 2-5 business days depending on location

We aim to complete the entire process within 2 weeks, but delays may occur due to government systems or courier services.

6. Cancellation and Refunds

6.1 Your Right to Cancel (Cooling-Off Period)

In accordance with the Consumer Protection Act, you have the right to cancel this agreement within 5 business days of signing up, without penalty and without giving any reason. During this cooling-off period, any payments made will be refunded in full within 15 business days.

6.2 Cancellation After Cooling-Off Period

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

  • Before Renewal Submission: Payments made are non-refundable but will be held as credit in your account for future use or can be applied to a new vehicle.
  • After Renewal Submission: No refunds are available once we have submitted your renewal application to NATIS, as we have already paid the government fee on your behalf.

6.3 Refunds for Service Failure

If we are unable to process your renewal due to our fault (not due to outstanding fines, incorrect information provided by you, or government system issues), we will refund the administration fee. Government license fees will be refunded if we have not already paid them to NATIS.

6.4 How to Request a Refund

To request a refund or cancel your subscription, please contact us at support@easynatis.co.za with your account details and reason for cancellation.

7. Delivery

7.1 Delivery Address

Your license disc will be delivered to the address you provide during registration. It is your responsibility to ensure this address is accurate, complete, and accessible.

7.2 Delivery Service

  • We use reputable courier services for all deliveries
  • You will receive a tracking number via SMS and email
  • Delivery is included in the administration fee at no extra cost
  • We deliver to all areas within South Africa

7.3 Failed Delivery

If delivery fails due to an incorrect address or no one being available to receive the package:

  • The courier will attempt redelivery or leave the package at a nearby collection point
  • You may be charged an additional fee for redelivery if the failure was due to incorrect information
  • Uncollected packages may be returned to us after 14 days

8. User Responsibilities

You agree to:

  • Provide accurate and complete information when registering and adding vehicles
  • Keep your account information and payment details up to date
  • Notify us promptly of any changes to your contact or delivery address
  • Maintain the confidentiality of your account credentials
  • Comply with all applicable laws and regulations
  • Not use our services for any illegal or unauthorized purpose
  • Not attempt to interfere with or compromise the security of our systems

9. Limitation of Liability

9.1 Service Limitations

While we strive to provide reliable services, we are not liable for:

  • Delays or failures caused by NATIS or government systems
  • Delays caused by courier or delivery services
  • Issues arising from incorrect information provided by you
  • Renewal failures due to outstanding traffic fines or other blocking issues
  • Service interruptions due to circumstances beyond our control (force majeure)

9.2 Maximum Liability

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or our services shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

9.3 Consumer Protection Rights

Nothing in these Terms limits your rights under the Consumer Protection Act or other applicable consumer protection laws. If any provision conflicts with these laws, the law shall prevail.

10. Intellectual Property

All content on our website and mobile application, including text, graphics, logos, icons, images, and software, is the property of EasyNatis or its licensors and is protected by South African and international copyright laws. You may not:

  • Copy, modify, or distribute our content without permission
  • Use our trademarks or branding without authorization
  • Reverse engineer or attempt to extract the source code of our software

11. Dispute Resolution

11.1 Internal Complaints Process

If you have a complaint about our services, please contact us at support@easynatis.co.za. We will acknowledge your complaint within 2 business days and aim to resolve it within 14 business days.

11.2 External Resolution

If we cannot resolve your complaint to your satisfaction, you may:

  • Lodge a complaint with the National Consumer Commission (for consumer disputes)
  • Refer the matter to an accredited industry ombud (if applicable)
  • Pursue alternative dispute resolution through mediation or arbitration

11.3 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any disputes that cannot be resolved through the above processes shall be subject to the exclusive jurisdiction of the South African courts.

12. Changes to Terms

We may update these Terms from time to time. When we make changes:

  • We will post the updated Terms on our website
  • We will notify you of material changes via email
  • The "Last updated" date at the top will be revised
  • Continued use of our services after changes constitutes acceptance of the new Terms

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EasyNatis regarding the use of our services.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations to a successor entity in the event of a merger or acquisition.
