Terms of Service

1.DEFINITIONS

1.1"Administration Fee" means our service fee, currently R201 per renewal cycle, charged for processing a renewal, the registered agent's NATIS submission, and managing the renewal through to delivery, as more fully described in clause 6;

1.2"Applicable Laws" means any South African laws, including any statute, regulation, notice, policy, directive, ruling or subordinate legislation, the common law, any binding court order, judgment or ruling, any applicable industry code, policy or standard enforceable by law, or any applicable direction, policy or order given by any regulator, competent authority or organ of state or statutory industry body, including without limitation the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA") and the Protection of Personal Information Act 4 of 2013 ("POPIA");

1.3"App" means the EasyNatis mobile application, available for iOS and Android devices;

1.4"License Fee" means the annual vehicle licence renewal fee set by the relevant provincial licensing authority for your vehicle, which is a government fee and not our income;

1.5"NATIS" means the National Traffic Information System, through which vehicle licence renewals are processed by the relevant licensing authority;

1.6"Personal Information" means any information as defined in POPIA, including but not limited to your name and surname, identification number, physical and delivery address, contact details, and vehicle registration information;

1.7"Platforms" means the Website, the App, and any other web-applications, campaign sites or channels of communication operated by us;

1.8"Product" means the vehicle licence disc renewal service offered by EasyNatis, including any related add-on offerings we may introduce from time to time;

1.9"RTMC Delivery Fee" means the fee, currently R99 per renewal cycle, charged by the Road Traffic Management Corporation to courier your renewed licence disc to you, which we pass on to you at cost;

1.10"Services" means all activities, support and value-added offerings provided by us in connection with the Product, including submission of renewal applications to NATIS, payment facilitation, account management, renewal reminders, status notifications, and nationwide delivery of renewed licence discs;

1.11"User Agreement" means the legally binding contract between you and us which sets out our reciprocal rights, responsibilities and limitations, comprising these Platform Terms and Conditions ("T's and C's");

1.12"Wallet" means the ring-fenced record we maintain reflecting funds you have prepaid towards a vehicle's licence renewal which have not yet been applied to the License Fee, RTMC Delivery Fee or Administration Fee, or refunded to you, as more fully described in clause 6.6;

1.13"Website" means https://easynatis.co.za and any successor domain; and

1.14"you" and "your" mean the user of the Platforms, and "we", "us" and "our" mean EasyNatis (Pty) Ltd, registration number 2025/811057/07, a company registered in the Republic of South Africa.

2.INTRODUCTION

2.1These T’s and C’s comprise of our User Agreement with you and regulate all interactions we have with you in relation to your use of the Platform and the Product.

2.2The interactions regulated by these T’s and C’s are:

2.2.1your access to and use of the Platform;

2.2.2your access to and use of the Platform, the information published on them, applying for the Product and/or Services, making use of payment functionality, and participating in any campaigns or promotions we run from time to time; and

2.2.3our processing and sharing of your Personal Information in order to provide you with the Product and Services.

2.3Your continued use of our Platforms is at your own risk and will represent your agreement to be bound by these T’s and C’s.

2.4We may need to amend these T’s and C’s at any time, and such changes will become effective upon such changes being posted to any of our Platforms. We therefore recommend that when you make use of our Platforms, you regularly read our T’s and C’s.

2.5We may amend these T's and C's from time to time, and any changes become effective once posted to the Platforms. We recommend that you check these T's and C's periodically. Where a change is material, we will also notify you by email in accordance with clause 20.

2.6Your attention is drawn to the clauses (in bold) which:

  • limit our risk or liability, or that of any other person;
  • constitute an assumption of risk or liability by you;
  • impose an obligation on you to indemnify us or any other person; or
  • constitute an acknowledgement of a fact by you.
  • 2.7These T's and C's should be read together with our Privacy Policy, which governs how we process your Personal Information. In the event of any conflict between the Privacy Policy and these T's and C's in respect of the use of the Platforms, these T's and C's take precedence.

    2.8In these T's and C's, a reference to the singular includes the plural, and a reference to a "legal entity" includes any entity recognised in law as a separate legal person, such as a company, close corporation, partnership, association or trust.

    3.THE USE OF OUR PLATFORM(S)

    3.1General

    3.1.1You may only access and use the Platforms within the confines of these T's and C's.

    3.1.2By accessing the Platforms and using the Product, you warrant that you meet the eligibility requirements set out in clause 5, including that you are at least 18 years of age. The Product is not intended for use by minors, whether directly or through a parent or guardian, because vehicle ownership and licensing obligations under Applicable Law rest with an adult registered owner.

    3.1.3Where you act on behalf of a legal entity that owns the vehicle in question, you warrant that you have the necessary authority to bind that entity to these T's and C's, and to provide proof of such authority within a reasonable time if requested.

    3.2Your Profile

    3.2.1To use the App and the Product, you will be required to set up a profile. You must keep your access details (including username and password) confidential and not allow others to use them. You accept full responsibility for all activity that occurs under your access details.

    3.2.2Any use of your access details will be treated as if you were the person using them.

    3.2.3You guarantee that all Personal Information and vehicle information you provide to us is true, accurate, current and complete, that you will update it promptly if it changes, and that you have fully disclosed all relevant facts, including any outstanding traffic fines known to you.

    3.2.4We will process your Personal Information, and disclose it to third parties such as our registered agent, payment processor and courier partners, for the purpose of providing you with the Product and Services. By accepting these T's and C's, you consent to this processing and transfer for that purpose.

    3.2.5You may browse certain parts of the Website without creating a profile. In such cases we may collect your device's IP address for analytics purposes, but not your name or other identifying information, and we use this only to understand how the Platforms are used.

    3.3Limitations of Use:

    3.3.1You agree not to:

    3.3.1.1reproduce, adapt, distribute, publish or otherwise interfere with the Platforms or their content, except as permitted in clause 12;

    3.3.1.2establish a hyperlink, frame or similar reference to the Platforms without our prior consent;

    3.3.1.3use the Platforms to process the Personal Information of third parties without their consent;

    3.3.1.4attempt to gain unauthorised access to us, our systems or the Platforms, including by hacking or password mining;

    3.3.1.5use the Platforms for any illegal or unlawful activity, including submitting a renewal application for a vehicle you are not authorised to act for;

    3.3.1.6post or transmit content that is unlawful, obscene, defamatory, discriminatory, harassing or offensive;

    3.3.1.7employ automated processes designed to negatively affect the performance of the Platforms; or

    3.3.1.8attempt to gain unauthorised access to our programming, coding or infrastructure, or circumvent any security feature.

    3.3.2We reserve the right to suspend or disable your profile and/or limit your access to the Platforms if you breach these T's and C's.

    4.OUR SERVICES

    4.1What We Offer

    4.1.1EasyNatis provides a vehicle licence disc renewal service for vehicles registered in South Africa, comprising:

  • monthly payment plans for annual vehicle licence renewal fees;
  • submission of licence renewal applications to NATIS on your behalf, through a registered agent;
  • nationwide delivery of renewed licence discs to your specified address;
  • automated renewal reminders and status notifications; and
  • account management through the Website and App.
  • 4.2What We Do Not Do

    4.2.1For clarity:

  • we do not issue licence discs, only NATIS and authorised registering authorities may do so;
  • we do not provide vehicle roadworthiness certificates (COFs);
  • we do not settle outstanding traffic fines on your behalf; and
  • we do not provide driver's licence renewal services (only vehicle licence discs).
  • 4.3Service Availability

    4.3.1The Product is available for vehicles registered in all nine South African provinces. Availability may be affected by NATIS system availability and government processing times, which are outside our control.

    4.4Our Role: Facilitator, Not Licensing Authority

    4.4.1EasyNatis is a facilitator. We are not a licensing authority and we do not issue licence discs. We submit your renewal to NATIS through an authorised agent, and we collect and pay over the License Fee on your behalf.

    4.4.2The License Fee is a government fee, not our income. We collect it from you and pay it over to the licensing authority. What we earn is the Administration Fee, which is shown separately every time we quote you.

    4.4.3The licensing authority decides whether a vehicle's licence is renewed, not us. It may decline, defer or requote a renewal for reasons we do not control and are not always told, including the vehicle's record, its registration status, or outstanding fines.

    4.4.4If the authority declines or does not process your renewal, we will tell you, release any Wallet funds we hold for that vehicle in accordance with clause 6.6, and set out what we understand the next step to be. We cannot compel the authority to renew a vehicle.

    5.ELIGIBILITY REQUIREMENTS

    5.1To use the Product, you must:

  • be at least 18 years of age;
  • be a South African citizen, permanent resident, or hold a valid work permit;
  • have a valid South African ID number;
  • be the registered owner of the vehicle, or have the registered owner's authorisation to act on their behalf;
  • have no outstanding traffic fines associated with the vehicle; and
  • provide accurate and complete information for the renewal application.
  • 5.2We rely on the information and warranties you provide under this clause and clause 3.2.3. You are responsible for the accuracy of that information, subject to clause 6.5.

    6.PAYMENTS AND YOUR WALLET

    6.1Pricing

    6.1.1Your monthly payment is calculated based on the License Fee (which varies by province and vehicle type), the RTMC Delivery Fee, and our Administration Fee. The total is divided by the number of months remaining until your licence expiry date, subject to a minimum of 1 month and a maximum of 12 months. All prices are quoted in South African Rand and are inclusive of VAT where applicable.

    6.1.2You will always be shown your exact quoted amount, with the License Fee, RTMC Delivery Fee and Administration Fee itemised separately, before you commit to a payment plan.

    6.2Payment Processing

    6.2.1Payments are processed on a prepayment basis through Peach Payments, a PCI-DSS Level 1 compliant payment provider. We do not store your full card details.

    6.2.2Monthly instalments are automatically debited from your registered payment card. You will receive a reminder before each debit date. Failed payments will be retried within 3 business days.

    6.3Late or Failed Payments

    6.3.1If a payment fails or is not received, we will notify you via email and SMS and give you 7 days to update your payment method or make a manual payment. Continued non-payment may result in suspension of your renewal, and we reserve the right not to proceed with your renewal if your account is not up to date.

    6.4Price Changes

    6.4.1Government licence fees may change annually. If the License Fee changes after you have started a payment plan, we will notify you of the change to your monthly payment and you may elect to continue on the adjusted amount or cancel in accordance with clause 9. Our Administration Fee is fixed at the time of sign-up for the current renewal cycle.

    6.5If Your Vehicle Details Are Incorrect

    6.5.1Your License Fee depends on your vehicle's type, tare (unladen) weight and province, which we take from the licence disc you scan or the details you provide. Every amount we show you is an estimate calculated from those details and the published provincial tariff, it is not a quotation from the licensing authority, and is only as accurate as the information we hold.

    6.5.2If those details are incorrect, or the licensing authority prices the renewal differently, we may correct our records and recalculate the renewal amount and your monthly payment. We will tell you before any recalculation changes what you pay.

    6.5.3When your renewal is submitted, the licensing authority's official quotation determines the fee actually payable, not our estimate. We check it against the amount collected before your renewal is finalised.

    6.5.4If the fee payable exceeds what we have collected, we will contact you with the details. If you believe our records are wrong, you may correct them and we will re-quote; otherwise, the difference must be paid before we submit your renewal. We will not debit the difference from your card without your agreement, and your renewal will be held (not cancelled) while this is resolved.

    6.5.5If the fee payable is less than we have collected, the difference is credited to your Wallet and may be refunded to you on request. Where a shortfall arises from information you provided that did not match your vehicle, the difference remains payable by you; where it arises from our error, we carry the cost.

    6.6Your Wallet

    6.6.1Every payment you make towards a renewal is credited to a Wallet that we maintain for you.

    6.6.2Funds held in your Wallet remain your money until they are applied towards the License Fee, RTMC Delivery Fee or Administration Fee, or refunded to you. We do not treat Wallet funds as our income, and we do not use them for our general operating purposes.

    6.6.3We only draw down on your Wallet, and pay the License Fee over to the licensing authority, once the full amount due for your renewal has been collected and your renewal has passed the eligibility verification described in clause 7.2.

    6.6.4Your Wallet does not earn interest, and we do not charge any fee for holding funds in your Wallet.

    6.6.5You can view your Wallet balance at any time through the App.

    6.6.6Wallet funds may only be applied to a licence renewal for a vehicle linked to your account. You may ask us to move a Wallet balance to another vehicle registered under your account, or request a refund in accordance with clause 9.

    6.6.7We keep funds held in your Wallet separately identifiable from our own operating funds.

    7.RENEWAL PROCESS

    7.1When We Process Your Renewal

    7.1.1We submit your licence renewal to NATIS once you have paid the full amount due (License Fee, RTMC Delivery Fee and Administration Fee). This typically occurs 1–2 weeks before your licence expiry date to allow time for delivery.

    7.2Eligibility Verification

    7.2.1Before processing your renewal, we verify that: your payment status is fully paid up; there are no outstanding traffic fines on the vehicle; your delivery address is valid and within South Africa; and your vehicle registration details are accurate.

    7.3Blocking Issues

    7.3.1If we identify an issue that prevents your renewal (such as outstanding fines), we will notify you immediately via email and SMS, explain the issue in plain language, and work with you on how to proceed, including resolving the issue and continuing, or pausing or cancelling with a refund of your unused Wallet balance in accordance with clause 9. We will process your renewal once the blocking issue is resolved.

    7.4Processing Time

    7.4.1NATIS processing times vary by province and are outside our control. Typical timeframes are 3–7 business days for NATIS processing, 1–3 business days for disc printing, and 2–5 business days for delivery. We aim to complete the process within 2 weeks, but delays may occur due to government systems or courier services.

    8.DELIVERY

    8.1Delivery Address

    8.1.1Your licence disc will be delivered to the address you provide during registration. It is your responsibility to ensure this address is accurate, complete and accessible.

    8.2Delivery Service

    8.2.1We use reputable courier services for all deliveries and you will receive a tracking number via SMS and email. The RTMC Delivery Fee is included in your quoted amount, so nothing further is payable on delivery. We deliver to all areas within South Africa.

    8.3Failed Delivery

    8.3.1If delivery fails due to an incorrect address or no one being available to receive the package, the courier will attempt redelivery or leave the package at a nearby collection point. You may be charged an additional fee for redelivery where the failure was due to incorrect information you provided. Uncollected packages may be returned to us after 14 days.

    9.CANCELLATION AND REFUNDS

    9.1Your Right to Cancel (Cooling-Off Period)

    9.1.1As this agreement is concluded electronically, you have the right under section 44 of ECTA to cancel it within 7 days of the date on which it was concluded, without penalty and without giving a reason. No charge, including no portion of the Administration Fee, may be levied on you for cancelling within this period, and any payments made will be refunded in full within 15 business days of your cancellation request.

    9.2Cancellation After the Cooling-Off Period

    9.2.1You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

  • Before renewal submission: you may leave what you have paid as Wallet credit to use later or towards another vehicle, or ask for it back. If you ask for it back, we keep only the Administration Fee contained in the payments you have actually made and refund the rest. Every payment carries the same proportion of Administration Fee as it does of the License Fee, so you are never charged Administration Fee for months you did not pay for.
  • After renewal submission: the License Fee and RTMC Delivery Fee have already been paid over on your behalf and cannot be recovered, and our Administration Fee is also retained as the work is complete at that point.
  • 9.2.2The Administration Fee we retain under this clause reflects our reasonable cost of the account administration, renewal preparation and processing work actually carried out for the period during which you were a subscriber. It is calculated strictly pro rata to the number of months you have actually paid for, is never more than the value of the administrative work performed up to your cancellation date, and is not a fee charged for cancelling, it is payment for work already done.

    9.2.3Nothing in this clause affects your cooling-off rights under clause 9.1, or your right to a refund under clause 9.3 where the failure is ours.

    9.3Refunds for Service Failure

    9.3.1If we are unable to process your renewal due to our own fault (excluding outstanding fines, incorrect information provided by you, or government system issues), we will refund the Administration Fee. The License Fee and RTMC Delivery Fee will also be refunded if we have not already paid them over on your behalf.

    9.4Refund Process

    9.4.1Approved refunds will be processed to your original payment method, or to your nominated bank account where card refund is not possible, within 15 business days of approval.

    9.5How to Request a Refund or Cancellation

    9.5.1To request a refund or cancel your subscription, contact us at support@easynatis.co.za with your account details and reason for cancellation.

    10.COMMUNICATIONS WITH YOU

    10.1General

    10.1.1When you use the Platforms or become our customer, you opt in to receiving communications from us via electronic channels, including email, SMS, WhatsApp and push notification, for purposes of marketing and providing the Product and Services to you.

    10.1.2Information you send us via the Platforms may be stored electronically by us and by the providers of the relevant communication channel.

    10.1.3Although we take reasonable steps to protect your information, we cannot guarantee the security of information transmitted online. We take reasonable steps to ensure third parties holding your information are bound by confidentiality obligations, but it remains your responsibility to review our Privacy Policy and any relevant third-party privacy policy.

    10.1.4Your access to and use of any third-party service provider referenced on our Platforms is subject to that provider's own terms, and you do so at your own risk.

    10.1.5Electronic communications sent to you will be regarded as received when sent, unless the contrary is proven. It is your responsibility to arrange, at your own cost, internet access and a suitable device to receive such communications. You agree that electronic communications from us satisfy any legal requirement for communications to be in writing.

    10.1.6You may opt out of marketing communications, or change your communication preferences, by contacting us at support@easynatis.co.za.

    10.2Phishing and Spoofing

    10.2.1If you receive any unsolicited communication that appears to be from EasyNatis asking for Personal Information, financial details, card numbers, usernames, passwords, or verification through a link, this is likely a fraudulent attempt to access your information.

    10.2.2EasyNatis does not request this type of information by electronic communication. We are not responsible for any consequences resulting from your response to such fraudulent communications. Please report any suspected phishing attempt to support@easynatis.co.za.

    11.THIRD PARTY PRODUCTS AND SERVICES

    11.1Our Platforms may reference or facilitate access to products or services offered by third parties, including our payment processor (Peach Payments) and courier partners, and may link to third-party websites ("Sites"). These third parties have their own separate terms and privacy policies.

    11.2We bear no responsibility or liability for the products or services rendered by such third parties, or the content of their Sites, regardless of whether such Sites bear our branding, and we bear no liability for any loss relating to your use of, or inability to use, such third-party services or Sites, even if expressly advised of the possibility of such loss.

    11.3Where you install or use our App, you may be required to accept the end-user licence agreement of an app store or other third party. That agreement is independent of these T's and C's, but both will apply to your use of the Platforms.

    11.4We make no warranties regarding the products, services or content of any third party accessible through the Platforms. We merely facilitate your access to such third parties' products or services and do not ourselves offer or render them.

    12.INTELLECTUAL PROPERTY RIGHTS

    12.1All content on the Platforms, including text, graphics, logos, icons, images and software, is our property or is used under licence from the relevant third-party proprietor. Unauthorised use, alteration or dissemination of this content is strictly prohibited.

    12.2No content on the Platforms grants any licence or right to use our trademarks without our prior written consent.

    12.3You may download a copy of certain information on the Platforms for your personal use only, provided you do not remove any copyright or trademark notice. Except as permitted by law, you may not copy, reproduce, republish, distribute or display Platform content, use data-mining tools, or mirror the Platforms, without our prior written permission.

    12.4We reserve the right to take appropriate legal action to protect and enforce our intellectual property rights.

    12.5Any comment, feedback, idea or suggestion you provide to us through the Platforms becomes our property, and you agree that we may use it for any commercial or non-commercial purpose without compensation to you. You acknowledge that you are responsible for the legality, originality and copyright compliance of any such material.

    13.BREACH

    13.1We consider the following as material breaches of these T's and C's:

  • pretending to be another person, or submitting a renewal application for a vehicle you are not authorised to act for;
  • transmitting material that violates, or could violate, the intellectual property rights or privacy of others;
  • using the Platforms in a way intended to harm, or that could result in harm to, you or other users; or
  • gathering information about others without their prior written consent.
  • 13.2Should you engage in any of the above, or otherwise breach these T's and C's, we are entitled, without prejudice to any other rights and without prior notice, to terminate or suspend your access to the Platforms, restrict your use of the Product, recover any costs and damages due to us, and pursue any other legal recourse available to us.

    14.LIMITATION OF LIABILITY

    14.1You acknowledge that Applicable Laws governing EasyNatis apply at all times to your use of the Platforms.

    14.2The Platforms and all content on them are provided on an "as is" basis and may include inaccuracies or errors. Neither we, our affiliates, directors, officers or agents will be responsible for any direct or indirect, special or consequential loss arising from your use of, or inability to use, the Platforms, or any linked Site, even if expressly advised of the possibility of such loss.

    14.3We are not liable for:

  • delays or failures caused by NATIS or other government systems;
  • a licensing authority declining, deferring or requoting a renewal;
  • delays caused by courier or delivery services;
  • issues arising from incorrect information you have provided, subject to clause 6.5;
  • renewal failures due to outstanding traffic fines or other blocking issues; or
  • service interruptions due to circumstances beyond our reasonable control (force majeure).
  • 14.4To the maximum extent permitted by law, our total liability for any claim arising from these T's and C's or the Services will not exceed the total amount you have paid to us in the 12 months preceding the claim.

    14.5We do not guarantee that the Platforms, their content, our servers, or any electronic communication sent by us will be free from viruses or other harmful components.

    14.6Nothing in these T's and C's limits your rights under the CPA or other applicable consumer protection law. Where any provision conflicts with such law, the law prevails

    15.INDEMNITY

    15.1By accessing and using the Platforms, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses, including legal fees, arising from or in connection with your use of the Platforms, including any breach of the warranties given in clauses 3.2.3 and 5.1.

    15.2The Product and Services are subject to the terms and conditions applicable at the time any transaction is finalised.

    16.DISCLAIMERS

    16.1While we take due care in providing access to the Platforms, we give no warranty, express or implied, including warranties of merchantability or fitness for a particular purpose, to the extent permitted by law.

    16.2We take reasonable steps to keep the Platforms free of viruses and malware, but are not responsible for any damage to your device arising from your use of the Platforms.

    16.3Display of content may differ depending on your device, and we are not responsible for any resulting display issues or incompatibility.

    16.4We take reasonable steps to ensure the uptime of the Platforms, but there may be downtime due to maintenance or upgrades, and we will not be liable if the Platforms are unavailable for any reason. Where possible, we will give advance notice of planned downtime.

    17.GOVERNING LAW AND DISPUTE RESOLUTION

    17.1Governing Law

    17.1.1The Platforms are controlled, operated and administered within the Republic of South Africa. Access from any territory where use of the Product or Services is unlawful is prohibited.

    17.1.2These T's and C's are governed by the laws of the Republic of South Africa. If any provision is found invalid or unenforceable by a court of competent jurisdiction, it will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.

    17.2Internal Complaints Process

    17.2.1If you have a complaint, please contact us at support@easynatis.co.za We will acknowledge your complaint within 2 business days and aim to resolve it within 14 business days.

    17.3External Resolution

    17.3.1If we are unable to resolve your complaint to your satisfaction, you may lodge a complaint with the National Consumer Commission, refer the matter to the Consumer Goods and Services Ombud ("CGSO") described in clause 23, or pursue alternative dispute resolution through mediation or arbitration.

    17.3.2Subject to clause 17.3.1, any dispute that cannot be resolved through these processes is subject to the exclusive jurisdiction of the South African courts.

    18.PRIVACY AND DATA PROTECTION

    18.1Privacy Policy

    18.1.1Before you share any Personal Information with us, please read and acknowledge our Privacy Policy, available at easynatis.co.za/privacy-policy. Where we process Personal Information requiring further disclosure, we will refer you to a specific privacy notice supplementing our Privacy Policy.

    18.2Cookie Policy

    18.2.1We use small amounts of information stored on your device ("cookies") to make your access to the Platforms easier, more useful and more reliable. These cookies do not identify you personally.

    19.CHANGES TO THESE TERMS

    19.1We may update these T's and C's from time to time. When we do, we will post the updated version on the Website, revise the "Last updated" date, and notify you of material changes by email. Continued use of the Platforms after a change constitutes your acceptance of the updated T's and C's.

    20.GENERAL PROVISIONS

    20.1Entire Agreement

    These T's and C's, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Platforms and the Product.

    20.2Severability

    If any provision of these T's and C's is found invalid or unenforceable, the remaining provisions continue in full force and effect.

    20.3No Waiver
